支持蒲台郊野公園 Support Po Toi Country Park



蒲台島是香港最南面的島嶼,島上除了多個著名地質景點如棺材石、佛手巖、靈龜上山等等外,亦是香港獨有盧氏小樹蛙的天然棲息地,蒲台島的獨特地理位置及天然環境亦造就她成為遷徙鳥類的重要補給站,島上記錄到的雀鳥品種超過300種,達全港總數的六成。

2012年初有人於島上清除植物及放置石屎板,破壞自然景觀及生態價值。原來規劃署早於2001年已建議蒲台群島劃作郊野公園,但一直未得到落實。

我們認為將蒲台島劃作郊野公園是保護該島景觀、生態、文化及康樂價值的最有效及最佳辦法。

Po Toi is the southern-most island of Hong Kong. The famous rock formations such as the Coffin Rock, Palm Cliff and Tortoise Climbing up the Mountain attract many hikers. Meanwhile, it is a natural habitat of the endemic Romer's Tree Frog which is internationally endangered. The special geographical location together with the natural environment makes the island a crucial refueling stop for migratory birds. More than 300 species - 60% of the Hong Kong Total - have been recorded from the island.

In early 2012 workers cleared vegetation on the island and put hundreds of concrete slabs on Po Toi, damaging the landscape and ecological value. In fact, the Planning Department has suggested in 2001 that Po Toi Islands should be zoned as Country Park but this has never happened.

We think that designating Country Park for Po Toi is the best way to protect its landscape, ecological, cultural and recreational values from destruction.

Suggested opinions for your reference:
1. Po Toi has high scientific value and conservation value, the Board should designate "Site of Special Scientific Interest" for Po Toi;
2. More than 300 species of birds have been found on Po Toi including many Hong Kong 1st Records;
3. Po Toi is a natural habitat for Romer's Tree Frog and the government should provide extra protection;

I support Po Toi as a Country Park and I hope the Town Planning Board and AFCD could:
1. Recognize Po Toi's Special Scientific Value, protect and conserve the feeding habitats of migratory birds, As Po Toi is a crucial refuelling stop for them, and is also a prime site for studying and appreciating migratory birds;
2. Po Toi is also one of the few natural habitats for the Endemic and Endangered Romer's Tree Frog, their habitats should be conserved;

DPA/I-PTI/1 蒲台群島發展審批地區草圖刊憲

城市規劃委員會(城規會)今日(三月二日)刊憲公布蒲台群島發展審批地區草圖,把蒲台島及其鄰近群島納入法定規劃管制的範圍。

城規會發言人說:「由即日起,該區受到城市規劃條例(條例)下的法定規劃及執行管制。除了這份發展審批地區草圖准許的用途外,任何發展必須先取得城規會 的規劃許可。任何發展若不符合這份發展審批地區草圖的規定,或未取得城規會批給的許可,即屬違例發展,當局可引用條例規定進行執行管制。」

蒲台群島發展審批地區草圖涵蓋約549.67公頃的土地。蒲台群島是指多個位於香港最南端的島嶼,主要包括蒲台、墨洲、螺洲、宋崗及橫瀾島。

城規會發言人補充:「任何人不遵從法定規定,即屬犯罪。首次定罪可處罰款最高50萬元;第二次或其後每次定罪,可處罰款最高100萬元。當局將嚴格執行管制所有違例發展。」

整體規劃意向是保護該區具重要科學價值和高保育價值的鄉郊自然景致,以免受到違例發展項目和不適當地改變用途的情況所侵擾,以及反映現有的認可鄉村和鄉郊民居的範圍。

約0.56公頃的土地劃為「鄉村式發展」地帶,以反映現有的認可鄉村的範圍。約549.11公頃的土地劃為「非指定用途」地帶,以便在制訂分區計劃大綱圖前,仔細進行分析及研究,訂定適當的土地用途。

城規會發言人說:「這份發展審批地區草圖為蒲台群島提供即時的法定規劃管制,以待擬備分區計劃大綱圖。當局將在三年內以分區計劃大綱圖取代該圖。」
蒲台群島發展審批地區草圖現置於城規會秘書處、位於北角和沙田的規劃資料查詢處、西貢及離島規劃處、離島民政事務處及南丫島南段鄉事委員會,讓市民於辦公時間內查閱。

任何人士可於二○一二年五月二日或之前,就有關草圖向城規會秘書處作出書面申述。

蒲台群島發展審批地區草圖複本現於北角及油麻地地圖銷售處發售。市民亦可於城規會網頁(www.info.gov.hk/tpb)瀏覽該草圖。

DPA/I-PTI/1  Draft Po Toi Islands Development Permission Area Plan gazetted

The Town Planning Board today (March 2) gazetted the draft Po Toi Islands Development Permission Area Plan (DPA Plan) to put Po Toi and its adjoining islands under statutory planning control.

"With immediate effect, the area is subject to statutory planning control and planning enforcement under the Town Planning Ordinance (the Ordinance). Any development, other than that permitted under the DPA Plan, requires planning permission from the Town Planning Board, and any development not in conformity with the Plan or without planning permission is an unauthorised development and would be subject to enforcement under the Ordinance," the spokesman for the Town Planning Board said.

The draft Po Toi Islands DPA Plan covers a total area of about 549.67 hectares.  Po Toi islands are the southern-most outlying islands in Hong Kong, which include mainly Po Toi, Mat Chau, Beaufort Island, Sung Kong and Waglan Island.  

"Any person who contravenes the statutory requirements commits an offence and is liable, in the case of a first conviction, to a fine of $500,000 and, in the case of a second or subsequent conviction, to a fine of $1,000,000. Any violation will be strictly enforced," the spokesman added.

The general planning intention is to protect the rural and natural landscape of the area with scientific importance and high conservation value from encroachment by unauthorised development and from undesirable change of use. The planning intention is also to reflect the existing recognised village and rural settlements.  

About 0.56 hectares of the land area is zoned "Village Type Development" to reflect the existing recognised village.  About 549.11 hectares of land area is designated as "Unspecified Use", pending detailed analysis and studies to establish the appropriate land uses in the course of preparing an Outline Zoning Plan.

"The draft DPA Plan is intended to put the islands under immediate statutory planning control pending the preparation of Outline Zoning Plan. It will be replaced by an Outline Zoning Plan within three years." the spokesman said.

The draft Po Toi Islands DPA Plan is now available for public inspection during office hours at the Secretariat of the Town Planning Board, Planning Enquiry Counters in North Point and Sha Tin, the Sai Kung and Islands District Planning Office, the Islands District Office, and the Lamma Island (South) Rural Committee.

Any person may make written representations in respect of the draft plan to the Secretary of the Board on or before May 2, 2012.

Copies of the draft plan are available for sale at the Map Publications Centres in North Point and Yau Ma Tei. The electronic version of the plan can be viewed at the Town Planning Board's website (www.info.gov.hk/tpb).

Does anyone know what is planned at the helipad? There is clearly construction underway. Today I observed a large pile of gravel and some large machinery on the helipad. Afraid whatever is planned might compromise habitat around the lagoon?

These are Government works being carried out by the Home Affairs Department and Lands Department, probably including improvement of helicoper pad and the footpath. The HKBWS office has asked for more information about the works, and we are still waiting for a reply.

又是一個走法律灰色地帶的實例!

【東方日報訊】東方報業集團早前率先揭發有私人發展商擬將蒲台島打造成墳場島,事件有新進展,兩間私人發展商昨日入稟高院,指將蒲台島的土地建成墓地並沒有違反政府規定。發展商現要求高院頒令,宣告發展商鋪平涉案土地及在有關土地上擺放石屎板,這種發展方式並沒有違反政府在一九○五年及一九三二年作出的批地條款;又指三二年的批地條款,亦沒有對涉案土地加設任何土地用途限制,故要求法庭准許發展商在已鋪好石屎板的土地下,存放和擺放骨灰龕。

有關:支持蒲台島劃作郊野公園

蒲台島及其鄰近群島因是位處香港最南端的一群離岸小島,所以於每年的春、秋兩季,也就是候鳥遷徙的季節時,是很多沿華南沿岸及對出海域遷徙的候鳥的中途休息及補給站,這功能特別在牠們遇上颱風或其他惡劣天氣時更為重要。由於這些遷徙候鳥中有很多是不愔水性,若當飛越茫茫大海時突然或將要遇上惡劣天氣時,卻沒有了這些離岸的海中小島作緊急的避風站,牠們便會很大機會葬身大海。

蒲台島上的樹林及各式植被正好是各種候鳥的藏身休息之所,島上曾記錄到雀鳥品種已超過300種,達香港有記錄雀鳥品種的六成,而且當中有不少更是香港其他地方罕見,甚至不曾有記錄的。所以如島上有任何大規模發展的話,這勢將令島上大量植被被清除殆盡,亦令到大量遷徙候鳥因而失去長途旅程中一個重要的中途休息或避風站。

故此本人支持並強烈要求城規會及漁農自然護理署落實2001年的建議,將蒲台群島劃作郊野公園,以為大群遷徙候鳥保存這個南面海域唯一的避風站。

城規會今天公佈蒲台群島發展審批地區草圖收到的175份申述,當中約80份支持保護蒲台島的生態價值及劃為郊野公園,另外竟有約90份意見希望發展所謂的紀念花園(骨灰場),包括發展商Splendid Resources Inc.

保護蒲台島仍需要大家的努力,請於6月15日或之前去信城規會,表達大家希望保護蒲台島的意見,請務必表明「支持香港觀鳥會(TPB/R/DPA/IPTI/1-4)的申述」,否則意見可能被城規會視作無效:

The Town Planning Board has published the 175 representations received, about 80 of them support protecting Po Toi's conservation value and support Country Park Designation. However, there are about 90 comments including the developer Splendid Resources Inc. supporting the development of the so called "Memorial Garden" (or "Columbarium").

We need your support to protect Po Toi! Please submit comments to the Town Planning Board on or before 15 June. Please clearly state "I support Hong Kong Bird Watching Society's representation (TPB/R/DPA/IPTI/1-4)" or the comments may not be recognized by the Board:

1. Po Toi has high scientific value and conservation value, the Board should designate "Site of Special Scientific Interest" for Po Toi. Hong Kong Bird Watching Society's detailed submission have proven the conservation value of Po Toi.
2. More than 300 species of birds have been found on Po Toi including many Hong Kong 1st Records;
3. Po Toi is a natural habitat for Romer's Tree Frog and the government should provide extra protection;
4. Po Toi has high value in landscape and recreational activities and the Government should designate it as a Country Park. By doing such, the government has the responsibility to promote tourism and improve the public utilities on the Island;
5. The illegal activities on the island has damaged Po Toi's ecological and landscape value. The Lands Department has been carrying out enforcement actions and other relevant authorities should control these activities.

支持香港觀鳥會(TPB/R/DPA/IPTI/1-4)的申述.

Nature provides us life and living through an organic delicate system.  All species are 'useful' and indispensable.  We’re all depended on one another.  We can live very well without columbarium. We cannot live without birds. We cannot live joyfully when birds become less and less.  If birds cannot survive, we cannot survive and we will extinct sooner than they.  Save Po Toi Island for ourselves and our children.  Give us a natural park to heal our over stressed souls in Hong Kong. Let there be a small humble island to sooth the heavy laden city people all over the concrete jungles.  Boman Ho (Cute)

Two questions spring to my mind regarding the HKBWS proposal:
1. The proposal seems to only concentrate on Po Toi Island. Could the HKBWS have taken this opportunity to also push for stronger protection of Waglan Island, which is home to an important colony of breeding terns (especially Bridled and Roseate) and Pacific Swifts. There is often disturbance to this island. The ecological value of other islands in the Po Toi group may also be relatively high, but does not seem to have been studied.

2. I note that the same document cited by HKBWS to propose Po Toi as a country Park also proposes Country Park status for South Lamma. Could the HKBWS not have taken a stronger stance against the proposed marina development on South Lamma, which is of a much larger scale than the proposed colombarium on Po Toi, threatening habitat for migratory birds, Romer's Tree Frog, Green Turtle and marine coral communities?

With regard to the South Lamma Marina I received a response from the Town Planning Board 30 April 2012. The response indicated that the proposal is basically dead. The Town Planning Board expressed concerns related to the the impact on local fisheries, inadequate transportation, and other concerns.

Yes the paper mainly focus on Po Toi Island. Nevertheless, HKBWS will also highlight the need of protection of other nearby islands during the hearing sessions of the Board, esp. waglan which is known to be an important site. Zoning of a "Conservation Area" would be the most appropriate if not a country park or special area. However, I guess the disturbances on Waglan are mainly come from recreational fishers and maybe some adventurers. This cannot be controlled through Town Planning system.

For the other islands they are not well studied due to inaccessibility, and that's why we did not provide much information on them. However, The planning department has recognized their value in terms of landscape quality.

About the case in Lamma as brendan said, is turned down at the moment. If it comes out again, it may be possible for HKBWS to join hands with other green groups to act. The document Brendan talked about could be obtained from

蒲台規劃與被規劃

Submitted comments week's ago in private capacity to Secretary for Development Designate, copied to other relevant B/Ds, in support of Po Toi's zoning and opposing to 'memorial garden' development. Thus far only a general reply from AFCD is received, pasted below for information.

Dear Sir/Madam,

I refer to your recent e-mail to this Department concerning Po Toi.

Please be advised that whether an area is suitable for designation as a country park should be assessed against the established principles and criteria, which include conservation value, landscape and aesthetic value, recreation potential, size, proximity to existing country parks, land status and existing land use.  Views of the Country and Marine Parks Board (the Board) on the assessment should also be sought.

Po Toi was first identified to have potential for country park designation by the Planning Department in 1993. This Department commissioned a study in 1999 which concluded that Po Toi would be suitable for country park designation.  The study was also endorsed by the Board in 2000. Due to the priority of the various designation proposals, the designation of Po Toi as a country park has yet to be initiated. Nevertheless, we have conducted various biodiversity surveys on Po Toi during the past decade, and confirm the ecological value of the Island.  

This Department would take the views and comments from members of the public, the latest development and planning of Po Toi, as well as the resource availability to consider the priority of the proposal to designate Po Toi as a country park.  At present, there is no definite plan to designate Po Toi as a new country park.

城規會在最近一輪的諮詢共收到725份意見,經過觀鳥會的點算,當中約100份是發展商找到的支持者,另有十多份未能判斷立場,換言之,在這一輪中支持保育蒲台的公眾意見超過600份! 謝謝各位有提交意見的朋友!

希望城規會委員門能重視大部份市民的意見,接納環保團體的專業意見和建議, 規管蒲台島上的發展; 漁護署亦應該回應市民的訴求,設立郊野公園,為蒲台群島提供更佳的保護。

The Town Planning Board received 725 comments in the last public consultation. HKBWS found that about 100 of them are on the side of the developer, while we cannot determine the position of about a dozen of submissions. In order words, there are more than 600 comments supporting the conservation of Po Toi! Thank you so much for your support!

We hope that the TPB members can take the comments of the wider public, adopt Green Groups' professional comments and suggestions to conserve Po Toi Island by controlling developments; AFCD should also response to the public by setting up Country Park to better protect Po Toi and surrounding Islands.

Hi, I've just received an email from TPB, saying that a meeting will be held on 28Sep2012 (Fri) for "Draft Po Toi Islands Development Permission Plan No. DPA/I-PTI/1".

May I ask any representatives of HKBWS will attend?  As it's on weekday, I may not be available to attend the meeting.  Will HKBWS collect our comments?

今天觀鳥會與香港地貌岩石保育協會、各界關注骨灰龕法案大聯盟、創建香港等團體出席城規會會議,同場的亦有反對骨灰龕的蒲台島居民。

發展商Splendid Resources Inc.在會前要求城規會押後會議,但城規會決定如期進行會議,及後Splendid 的代表未有出現於會議作表述。

幾個團體都表示支持城規會的草圖以管制島上發展,但將蒲台群島納入郊野公園才能全面保育蒲台群島及對居民有利。觀鳥會指出蒲台島上的保育價值極高,以及島上值得好好保存的生態環境,亦指出多項蒲台不適宜建骨灰龕的理據。

一些反對骨灰龕的蒲台島居民表示他們的意見未得到尊重,甚至懷疑有人在未得到共識前,利用「蒲台島值理會」的名義提交支持骨灰龕的意見。

城規會仍在閉門審議當中,未知今天會否有結果,但順應發展商要求的機會不大。


The HKBWS with groups such as Association for Geoconservation, Alliance for The Concern over Columbarium Policy and Designing Hong Kong attended the Town Planning Board Meeting today. There were also a group of Po Toi villagers who object to the columbarium.

Before the meeting started, the developer Splendid Resources Inc. requested the Town Planning Board to defer the meeting but the Town Planning Board decided to continue the meeting as scheduled. After that, Splendid was not present at the hearing session of the meeting.

The groups expressed support to the Town Planning Board's draft plan to control development on the island but raised that designating Po Toi Islands as Country Park is the best to the environment and residents. HKBWS pointed out that the island is of very high ecological value and the habitats that require protection, as well as the reasons that columbarium use is not suitable on Po Toi.

Some villagers that objected to the columbarium development said that their opinions have not been reflected, and some even claimed that somebody used the name of the "Po Toi committee for organising festival events" ("蒲台島值理會") without having a consensus.

The Town Planning Board is still having an internal discussion. It is not sure whether they have the conclusion today but it is unlikely that the board would make decisions in favour of the developer.

The Town Planning Board approved the Draft Po Toi Plan without amendments, The detailed planning on Po Toi will be decided during the preparation of the Outline Zoning Plan in the future 3 years. Green Groups and citizens concerned about the natural environment still need to fight in the future.

So Po Toi has been saved from illegal and unwanted destruction for at least three years and hopefully for the whole future, for all the people of Hong Kong and for future generations to enjoy.

Thanks to all those individuals who made a contribution including sending in their comments to Town Planning Board and Lands Department.

And particularly to Beetle Cheng who organised our response and co-ordinated with other groups so well. A fitting way for him to end his time with HKBWS.

Draft Po Toi Islands DevelopmentPermission Area Plan No. DPA/I-PTI/1
(Comment No. C240)



        Irefer to my letter to you dated 21.9.2012.

        Aftergiving consideration to the representations and related comments, the TownPlanning Board (TPB) noted on 28.9.2012 the views of the RepresentationsNo. R1 to R83 in support of the draft Development Permission Area (DPA)Plan and agreed to advise them that:

the DPA Plan is an interim planwhich can be replaced by an Outline Zoning Plan (OZP) within 3 years.  Inthe preparation of the OZP, land use zonings for the Area will be comprehensivelyreviewed subject to a more detailed analysis of the land use pattern, infrastructuralprovisions, environmental and ecological values and local need.  Relevantstakeholders including green groups, the concerned government departments,Islands District Council, and the Lamma Island South Rural Committee willalso be consulted.

        TheTPB also agreed to advise the Representations No. R1, R2, R4, R7, R9, R75,R80 and R83 that:

(a)        theissue of “Destroy First, Build Later” had been thoroughly discussedby the Board on 24.6.2011.  The TPB is determined to conserve therural and natural environment and will not tolerate any deliberate actionto destroy the rural and natural environment in the hope that the TPB wouldgive sympathetic consideration to subsequent development on the site concerned. Since then, the TPB has adopted a practice to defer considerationof a planning application which may involve an unauthorised development(UD) so as to allow time for Planning Department (PlanD) to carry out fullinvestigation into whether there is UD on the site; and

(b)        theDPA Plan is prepared to empower the Planning Authority to undertake enforcementaction against any UD and undesirable change of use in the Area.  ShouldUD be identified in the future, enforcement action will be instigated underthe Town Planning Ordinance.

The TPB also decided not to proposeamendments to the above Plan to meet the Representations No. R1 to R129,R131 to R133 and R135 to R175 for the following reasons:

(a)        toprevent any haphazard and uncontrolled development that may adversely affectthe rural and natural character of the Area, it is necessary to preparethe DPA Plan covering the Area to provide interim planning guidance controlfor future development pending preparation of an OZP and to enable enforcementactions to be taken against any unauthorized developments and undesirablechange of use to safeguard the Area’s natural and rural character withscientific importance and conservation value;

(b)        theDPA Plan is an interim plan which can be replaced by an OZP within 3 years. Detailed land use zonings will be worked out during the OZP stagetaking into account relevant assessments / studies on various aspects includingtraffic, environment, ecology, landscape, geological, etc.  In thepreparation of the OZP, land use zonings for the Area will be comprehensivelyreviewed subject to a more detailed analysis of the land use pattern, infrastructuralprovisions, environmental and ecological values and local need in consultationwith Government departments concerned.  Relevant stakeholders includinggreen groups, the concerned Islands District Council and the Lamma IslandSouth Rural Committee will be consulted;

Designation of ConservationZonings (R1 to R7, R9 to R74, R76 to R79, R82 and R83)

(c)        whilstthere is potential to designate conservation zonings, including “ConservationArea” (“CA”), “Coastal Protection Area” (“CPA”) and/or “Siteof Special Scientific Interest” (“SSSI”), in the Area (especiallyin Po Toi), the details of the designation need to be carefully studiedin the course of OZP preparation to ensure a balance between the rightsof indigenous villagers of Po Toi and nature conservation should be struck. Relevant assessments/studies on various aspects including ecology,environment, landscape, geology, etc. will be conducted in consultationwith the government departments concerned.  Relevant stakeholderswill be consulted during the process;

Designation of Country Park/ Marine Mark (R1 to R7, R9 to R74, R76 to R79, R82 and R83)

(d)        designationof Country Park and Marine Park is under the jurisdiction of the Countryand Marine Parks Authority (CMPA) governed by the Country Parks Ordinance(Cap. 208) and Marine Parks Ordinance (Cap. 476) which are outside thepurview of the TPB;
        
        Boundaryof the “Village Type Development” (“V”) zone (R2, R3, R84 toR87, R90 and R91)

(e)        thecurrent “V” zone boundary has primarily reflected the existing villageclusters and has excluded the sandy beach at Tai Wan.  It has alsotaken the coastline, existing man-made features, the high water mark level,‘village environs’, local topography and site characteristics intoaccount, avoiding any ecologically sensitive areas and stream courses; (R2 and R3)

(f)        theboundary of “V” zone within the DPA Plan is drawn up provisionallyto primarily reflect existing village clusters and has taken into accountthe coastline, existing man-made features, the high water mark level, ‘villageenvirons’, local topography and site characteristics.  It will befurther reviewed and defined at the preparation of OZP stage taking intoaccount the results of relevant assessments / studies on various aspectsincluding Small House demand of Po Toi, ecology, environment, geology,infrastructure, landscape, traffic, etc.; (R84 to R87, R90 and R91)

Proposed Amendments to the “UnspecifiedUse” area (R85, R86, R88 to R129, R131 to R133 and R135 to R175)
               
(g)        thereis no evidence or information to establish that there is any existing ‘Columbarium’/ ‘Memorial Garden’ use at southwest Po Toi. Besides, even if the alleged‘Columbarium’ and/or ‘Memorial Garden’ use is an ‘existing use’under the Town Planning Ordinance, it does not necessarily mean that the‘existing use’ would become a planned use and can meet relevant legislationand government requirements including the conditions of the lease concerned. The proposed Columbarium / Memorial Garden development may also haveimmense implications on traffic, infrastructure, landscape, ecology, environment,etc. and may conflict with the general planning intention of conservingthe scientific and conservation values of Po Toi.  In any event, appropriatezonings guiding the land uses and developments of the Area will be formulatedfor the Area at the preparation of OZP stage taking into account relevantassessments/ studies on various aspects including ecology, environment,geology, infrastructure, landscape, traffic, etc;

Proposed Columbarium/MemorialGarden Development (R94 to R121)

(h)        accordingto the Notes of the DPA Plan, the proposed Columbarium / Memorial Gardendevelopment would require planning permission from the TPB.  Eachapplication would be considered by the TPB on its individual merits;

       Proposals not directly related to the DPA Plan

        Provisionof facilities in the Area (R4 and R8)

(i)        theappropriateness to provide tourist, infrastructure and utility facilitiesfor tourism and recreational purposes in the Area requires detailed considerationand assessments in consultation with relevant government departments.  Assuch, the need for providing such facilities in the Area and designationof appropriate zonings, if required, will be further studied at the preparationof the OZP stage;

       Resumption of village layout plans preparation (R1)

(j)        thepreparation of new village layout plans for villages covered by existingOZPs will depend on a number of factors such as implementation prospectof the village layout plans, manpower and priority of work within PlanD. For the new DPA Plans which have just been completed such as thisDPA Plan, OZPs with specific land use zonings should be prepared beforelayout plans can be contemplated.  As the boundary of the “V”zone will be further reviewed and defined at the preparation of OZP stage,the need for preparation of new village layout plans for the “V” zoneto be covered by the OZP will then be reviewed as appropriate;

Preparation of statutory plansfor other areas (R1)

(k)        ithas been the Government’s long-term target to prepare statutory plansfor all areas of Hong Kong except areas covered / to be covered by CountryPark (CP).  Such task will be undertaken having regard to developmentpressure, priorities and resource availability; and

        Suspendthe processing of Small House applications (R1)

(l)        processingof land grant applications under the Small House policy is outside thepurview of the TPB.

        Acopy of the relevant extract of minutes of the TPB meeting held on 28.9.2012is enclosed herewith for your reference.

        Inaccordance with section 8 of the Town Planning Ordinance, the above Plantogether with a schedule of the representation(s) and comment(s), if any,will be submitted to the Chief Executive in Council for a decision.

               城市規劃委員會(下稱「城規會」)於二零一二年九月二十八日考慮有關申述和相關意見後,備悉申述編號R1R83表示支持制定這份發展審批地區草圖(下稱「草圖」),並同意告知申述人下述事宜︰

這份草圖是一份臨時圖則,可在三年內由分區計劃大綱圖取代。在擬備分區計劃大綱圖時,規劃署會更加仔細分析該區的土地用途模式、基礎設施是否足夠,環境和生態價值以及區內人士的需要,然後全面檢討該區的土地用途地帶的規劃。規劃署亦會諮詢相關的持份者,包括環保組織、有關的政府部門、離島區議會和南丫島南段鄉事委員會。

               城規會亦同意告知申述編號R1R2R4R7R9R75R80R83下述事宜:

(a)        對於「先破壞,後建設」的問題,城規會於二零一一年六月二十四日曾進行詳細討論。城規會決心保護鄉郊及天然環境,不會容忍任何蓄意破壞鄉郊及天然環境以期城規會從寬考慮有關土地上的其後發展的行為。自此之後,凡規劃申請可能涉及違例發展,城規會便會延期考慮,讓規劃署有時間進行全面調查,以確定申請地點是否有違例發展;以及

(b)        擬備這份草圖,就是賦權規劃事務監督對該區的違例發展及不適當地改變用途的情況採取執管行動。若日後發現有違例發展,規劃事務監督必會根據條例採取執管行動。

               城規會亦決定不建議順應申述編號R1R129R131R133R135R175而對上述圖則作出修訂,理由如下:

(a)        為防止出現雜亂無章和未受規管的發展項目,影響該區的鄉郊自然特色,有必要擬備這份涵蓋該區的發展審批地區圖,讓規劃署在擬備分區計劃大綱圖前,能為該區日後的發展提供臨時規劃指引和規管各項發展,以及採取執管行動,對付違例發展和不適當地改變用途的情況,以保護該區具重要科學和保育價值的自然鄉郊特色;

(b)        這份草圖是一份臨時圖則,可在三年內由分區計劃大綱圖取代。到了擬備分區計劃大綱圖的階段,規劃署會考慮交通、環境、生態、景觀和地質等各方面的評估/研究結果,詳細規劃該區各土地用途地帶。在擬備分區計劃大綱圖時,規劃署會更加仔細分析該區的土地用途模式、基礎設施是否足夠,環境和生態價值以及區內人士的需要,然後全面檢討該區的土地用途地帶的規劃,並徵詢有關政府部門的意見。規劃署亦會諮詢相關的持份者,包括環保組織、離島區議會和南丫島南段鄉事委員會;

劃設保育地帶(R1R7R9R74R76R79R82R83)

(c)        雖然該區(特別是蒲台)有潛力劃設保育地帶,包括「自然保育區」地帶、「海岸保護區」地帶及/或「具特殊科學價值地點」地帶,但在該區劃設保育地帶的詳情須留待擬備分區計劃大綱圖時才進行仔細研究,確保能在維護蒲台原居村民的權益與自然保育兩者之間取得平衡,屆時會考慮生態、環境、景觀和地質等各方面的評估/研究結果,並會徵詢有關的政府部門的意見。規劃署在過程中亦會諮詢相關的持份者;

劃設郊野公園/海岸公園(R1R7R9R74R76R79R82R83)

(d)        劃設郊野公園及海岸公園,根據《郊野公園條例》(208)及《海岸公園條例》(476),是由郊野公園及海岸公園委員會負責,不由城規會管轄;

「鄉村式發展」地帶的範圍(R2R3R84R87R90R91)

(e)        現時所劃的「鄉村式發展」地帶的界線主要反映現有村落聚集之處,並不包括大灣的沙灘,另外,亦已考慮海岸線、現有的人工構築物所在、高水位線、「鄉村範圍」、當地地形和土地特點,並避免劃入生態易受影響的地點和河道;(R2R3)

(f)        草圖所劃的「鄉村式發展」地帶的界線是暫時性的,主要反映現有村落聚集之處,並已考慮海岸線、現有的人工構築物所在、高水位線、「鄉村範圍」、當地地形和土地特點。到了擬備分區計劃大綱圖的階段,規劃署會考慮關於蒲台對小型屋宇的需求、生態、環境、地質、基礎設施、景觀及交通等各方面的評估/研究結果,再檢討和劃定「鄉村式發展」地帶的界線;(R84R87R90R91)

建議修訂「非指定用途」地區(R85R86R88R129R131R133R135R175)

(g)        沒有任何證據或資料確定蒲台西南部現有任何「靈灰安置所」/「紀念花園」用途。此外,即使所指的「靈灰安置所」及/或「紀念花園」用途是《城市規劃條例》所指的「現有用途」,亦不代表該「現有用途」會成為規劃的用途及符合相關法例和政府部門的規定(包括相關的地契條款)。發展擬議的靈灰安置所/紀念花園,可能會對交通、基礎設施、景觀、生態、環境等方面有巨大的影響,更可能有違保護蒲台的科學和保育價值的整體規劃意向。無論如何,到了擬備分區計劃大綱圖的階段,規劃署會考慮有關生態、環境、地質、基礎設施、景觀、交通等各方面的評估/研究結果,然後劃定適當的用途地帶,為該區的土地用途和發展提供指引;

發展擬議的靈灰安置所/紀念花園(R94R121)

(h)        根據草圖的《註釋》,發展擬議的靈灰安置所/紀念花園,必須取得城規會的規劃許可。城規會會按每宗申請的個別情況作出考慮;

與這份草圖沒有直接關係的建議

在該區提供設施(R4R8)

(i)        究竟是否適宜在該區提供旅遊、基建及公用事業設施配合旅遊業及康樂用途,必須與相關的政府部門商討,然後作出詳細考慮和評估。因此,規劃署會在擬備分區計劃大綱圖的階段,進一步研究是否有需要在該區提供這些設施,以及如有需要劃設用途地帶,須劃設哪些地帶才合適;
恢復制訂鄉村發展藍圖(R1)

(j)        是否要為現有分區計劃大綱圖涵蓋的鄉村擬備新的鄉村發展藍圖,要視乎若干因素而定,例如能落實鄉村發展藍圖的機會、規劃署的人手和工作的緩急優次。至於剛制訂的新發展審批地區圖(例如這份發展審批地區圖),必須待日後擬備分區計劃大綱圖,劃定明確的土地用途地帶,然後才能考慮擬備發展藍圖。規劃署會在擬備分區計劃大綱圖的階段,進一步檢討和劃定「鄉村式發展」地帶的界線,屆時便會檢討是否有需要為分區計劃大綱圖所涵蓋的「鄉村式發展」地帶擬備新的鄉村發展藍圖;

為其他地區制訂法定圖則(R1)

(k)        政府的長遠目標是為本港所有地區(郊野公園涵蓋/將會涵蓋的地區除外)擬備法定圖則。規劃署會視乎發展壓力、工作緩急優次及是否有所需資源而進行有關工作;以及

暫停處理小型屋宇申請(R1)
(l)        根據小型屋宇政策提出的批地申請,並不是由城規會負責處理。

根據《城市規劃條例》第8條的規定,上述圖則連同列出有關申述及意見(如有的話)的附表,將一併呈交行政長官會同行政會議決定。
