Based on leg structure it's a passerine. Colour, size and plumage fit Zitting Cisticola. I think it is 'wrapped' in a dark leaf which makes upper body look dark.

I think it was a Plain Prinia, the tail (before the Kite ripped it off) was quite long. It swallowed the prey whole in the end before flying off...
