I think you'll find that the bird you photographed is a Japanese Bush Warbler Cettia diphone. It is too small and the tail too wide for ORW. The upperparts are too warm and the supercilium shape and definition are not right. It also appears too small.

I do not think so. In case of Japanese Bush Warbler, the colour of legs should be a little pink however this is dark brown.

Yes, you are right about the leg colour. Still, this bird seems odd for ORW, probably because it's so foreshortened. After much discussion in my office, we agreed, however, that it was an ORW, though photographed under difficult circumstances.
