本會自然保育委員會已於今天發出電郵，向民航處處長查詢有關詳情，待收到回覆 後會在此公佈。
The HKBWS Conservation Committee have emailed to the Director-General of Civil Aviation to enquire about the issue. The results will be posted here when we get the reply.

以下是民航處回覆本會有關查詢的內容:
根據本處的記錄，本處於二零零六年一月一日曾接獲懷疑有人在南生圍上空駕駛動力滑翔傘（Powered Paraglider）來回飛行的投訴，當時本處職員已即時通知機場區警署。就此事件， 本處已再聯絡機場區警署並解釋駕駛動力滑翔傘所須遵守的相關民航條例。
動力滑翔傘可視作動力驅動飛行器 (Power Driven Flying Machine)的一種，因此受民航條例監管。對於閣下的相關問題，現回覆如下：
1a.如果要在香港使用動力滑翔傘飛行，必須遵守相關民航條例，例如對於航空器 註冊及飛行員牌照等的要求。
1b.滑翔傘的活動範圍已被限制在香港的九個區域，詳情見《香港航空資料匯編》( Aeronautical Information Publication)( http://www.hkatc.gov.hk/HK_AIP/aip.htm)。動力滑翔傘則必須與其他小型飛機一樣，在指定的空域內進行活動。
1c.南生圍在小型飛機活動空域內，飛行高度受民航條例所限制。
2a.至於當日該名駕駛動力滑翔傘人士在南生圍上空飛行是否合法，則要視乎他是� _持有適當牌照及有否違反其他民航條例。
2b.若沒有適當牌照，他可能已觸犯《1995年飛航（香港）令》。
2c & d.至於照片是否可以作為證據起訴該名人士，又或者有目擊證人和照片是否已經具 備足夠證據拘捕該名人士，請徵詢警方意見。
3a, b & c. 如日後發現有同類事件，請盡快通知警方。
在此多謝你所提供動力滑翔傘活動的資料，這有助本處作日後跟進和確保航空安全 。

The reply from Civil Aviation Department is summarized and translated as below:
- Powered Paraglider is considered as a Power Driven Flying Machine which is under the control of Civil Aviation Ordinance.
- Driving Powered Paraglider within HK must have a proper license and the machine should be registered. Otherwise, the pilot and the machine owner are offending the Air Naviagtion (Hong Kong) Order 1995 (CAP 448C).
- Same as other small aircraft, the Powered Paraglider must fly within the designated airspace.
- Nam Sang Wai is within the airspace for small aircraft. The flying height is under the control of Civil Aviation Ordinance.
- Whether a photo or a witness is sufficient for prosecuting the pilot of the Powered Paraglider, further advice from Police should be consulted.
- If Powered Paraglider activity is discovered again, please report to the Police at once.
此外，民航處職員口頭確定，直至目前為止，沒有動力滑翔傘在香港得到註冊及並 未發出任何相關的飛行員牌照；即是，現時所有在香港進行動力滑翔傘的活動均是 非法。
如果同類事件再次在南生圍發生，請立即至電 元朗警處報案室（電話：2476 5886）。
In addition, as verbally confirmed by an officer of Civil Aviation Department, up to this moment, no Powered Paraglider was registered in HK and the Dapartment has never issued any licence for it. This means any Powered Paraglider activity carried out in HK now is illegal.
If you find it happens again in Nam Sang Wai, please report at once to Yuen Long Police Report Room (Tel: 2476 5886).

Useful information that confirms the paragliding was illegal. Those who will visit the area should bring along the contact number for speedy reporting.

今日有朋友在尖鼻嘴一帶見到"電動降傘". 他隨後打給我. 希望以後見到的. 可即時打給 元朗警處報案室（電話：2476 5886),跟他解釋已向民航處了解這是違法的. 可立刻採取適當行動!! 謝~!
