尖鼻咀堆填 Dumping at Tsim Bei Tsui

今日行到沙橋咀村 係蠔田以北看到 沿紅樹林邊堆填 一直入到紅樹林 直達海邊 在附近發現一間鐵皮屋有鳥網設施 內裡傳出不同鳥類的叫聲(似是飼養的鳥類) 從村民口中得知 堆填的地方會有新的「教育」設施和米埔式浮橋 會有雀鳥睇 我相信兩者可能有關係 會否出現另一個「觀鳥軒」?

This is at Sha Kiu Village on Tsim Bei Tsui. It is illegal to cut mangroves and to dump in a fishpond. KFBG will investigate this afternoon and follow up with the relevant government departments Cheers Mike K

This case shows green groups can work together with the government to combat trashing of the environment: 1. birders get to so many remote places which no group can hope to survey on a regular basis, 2. then the groups can use their knowledge to provide the most useful and accurate information to the right department 3. the government can then begin the legl enforcement process which the others cannot do. the role of the BBS in passing this knowledge on, especially with photos, and FAST is also a critical part of the process. Thank you for follow up this case One important thing is local people want to build other "Mai PO " on their land to "education" and attract people (birds watcher) for making money. I dont think their are wrong, but they seem to misunderstand what the birds watcher needs and fail to know how to develop their own land in a sustainable way. And i think this is the mail problem of HK environment

They may have good intention even if it also includes some commercial elements to sustain the idea. Hopefully relevant authorities and environment groups can work out with them a win-win solution.

One more dumping report: Near KAM SHEUNG RD between LAI UK TSUEN and DAO UK TSUEN. I saw it on the KMB, Route No.: 64K.

In respnse to kumanfai's comments about a win-win situation: There can be no question of a "second Mai Po" or win-win when the people responsible for dumping are breaking the law. Villagers often use such excuses to hide the reality - they want to build more small houses or make space for open storage without seeking permission. The site at Sha Kiu in Tsim Bei Tsui is zoned as"Coastal Protection Area" and any dumping must have permission from the town planning board to change the zoning first. Also it is not permitted to knock down mangroves or to dump construction and demolition waste, or to fill in a fish pond. Another dumping site was found in the same area on Tuesday, but closer to Lau Fau Shan, where the dumping of constrcution waste was witnessed, but could not be stopped. If you witness such incidents please try to get the number of the truck and record the exact time of the dumping. It is sometimes possible to trace the waste to a construction site, and the site manager has responsibility for proper disposal of waste. If it is not being properly disposed the site engineer is responsible for failing to enforce the trip ticket system, which is supposed to control the dumping of construction waste. KFBG will continue to monitor this issue very closely.

Thanks to Mike for enlightening me and please excuse me for being naive in environmental protection regulations. I can understand what position to take now and will help to halt illegitimate dumping as briefed.

Plan Dept's formal reply to an enquiry from KFBG revealed that an Enforcement Notice was issued to the person responsible on 14 Nov 2005. A reinstatement notice (RN) was subsequently issued on 13 Dec 2005. Further prosecution action will be taken if they cannot comply the requirement of RN by 13 March 2006. Regarding another similar case near Wan Fou Sin Koon (雲浮仙觀), Lau Fau Shan, a warning letter was sent on 30 Dec 2005. As the pond filling work was continuing after sending the letter, an Enforcement Notice will be issued shortly. So, Planning Dept is undertaking actions. It will take one whole migration season to proceed to the prosecution stage. Very slow though it is better than none.
