Yes Dark-sided Flycatcher.
Do you eventually have other pictures of this bird? especially some on wich may appreciate the wing projection compare to the tail. On this pic wings appears quite long. ANother pic showing the underparts would be of interest as well.

do you have one on wich the wing tip is not hidden by the tail and hold above the tail?

it just flied away after I had it three shots.  All with the wings below the tail.
